Smartinga terms and conditions
Version 1.3, effective 8 October 2026.
This is a translation of the Dutch terms at smartinga.com/voorwaarden. If the two differ, the Dutch text prevails.
v1.3 (8 October 2026): a language change in the Dutch text only (it now addresses you with the informal "je"), and the parent button is now the parents' lock, with a PIN. No other change in content.
Article 1. Who we are
Smartinga is a service of Developly B.V., Lumierestraat 36, 1087 KH Amsterdam, the Netherlands, Chamber of Commerce no.: 42070503, VAT no. NL869571795B01, email info@smartinga.com. In these terms, Developly B.V. is called "we" or "us".
You can reach us by email. We answer within 3 working days. For complaints, see Article 19.
Article 2. What we mean by ...
- Smartinga: the app and the website (smartinga.com, app.smartinga.com) for learning to read and do maths, with stories, words, flash cards, maths cards, games and practice tests, and for learning Dutch.
- You: the adult who uses Smartinga or creates an account: a parent or guardian, or an adult learning Dutch themselves. You are not acting for your profession or business (you are a "consumer").
- Child: a child who uses Smartinga under your responsibility.
- Account: the account you create at Smartinga, with your email address or with Google.
- Child profile: the place in the account for one child, with a nickname, a picture, the levels and the progress.
- Free part: what can be used in Smartinga without a subscription.
- Subscription: the agreement under which you can use everything in Smartinga, in return for payment.
- Trial: the first 14 days of a subscription, free.
- Stripe: Stripe Payments Europe Ltd., the company that processes the payments on the website for us.
Article 3. When do these terms apply?
- These terms apply to every use of Smartinga, with or without an account, and to every subscription.
- You can always read, save and print the terms at smartinga.com/voorwaarden (Dutch) and on this page (English). When you create an account and before you take out a subscription, we point you to these terms.
- How we handle your data and your child's is in the privacy statement, on our website in Dutch and in English.
- We conclude the agreement in Dutch. These terms are also in English. If the two differ, the Dutch text prevails.
- If the law gives you, as a consumer, more protection than these terms, the law applies.
Article 4. The service
- Smartinga helps children (about 4 to 12 years old) practise reading and maths. Adults learning Dutch can use Smartinga too.
- Smartinga works in an ordinary browser on a tablet, phone or computer, and can be added to the home screen. Part of it also works without internet.
- The free part can be used without an account and without paying. Which stories, cards, games and exercises are free, you see in the app: what is not free is marked in the app. We may change the free part.
- With a subscription the children in your account can use everything in Smartinga, up to the number of children that comes with your subscription (Article 8).
- Smartinga is a practice program. It is not a test, not a school recommendation and not a diagnosis. The levels and the suggestions in the app help with practising; you can always change them yourself. So do not base an important decision about school on Smartinga alone.
- We do our best to make and check the stories, exercises, explanations and pronunciation well. Still, something can be wrong or not fit well. Do you see something like that? Email us at info@smartinga.com; we will fix it or take it out.
- Smartinga plays words and sentences with recorded sound. Without internet, the app may use your own device's reading voice; it sounds different on every device. Smartinga uses no microphone and no camera.
Article 5. Without an account
- Without an account, Smartinga keeps the progress and the settings only on the device.
- That data can be lost, for example if the browser clears its storage, the device breaks or you clear the browser data. We cannot get it back then. With an account, the progress is kept.
Article 6. Your account
- You create an account if you are 18 or older. You create an account for children as the parent or guardian of those children. Children do not create an account and do not log in.
- You give a correct email address and keep your password secret. What happens with your account is your responsibility, unless you have told us someone else is using it without your permission. Do you think someone else is using your account? Then change your password, log out on the other devices (Ouders → "Account", Parents → Account) and email us.
- An account can hold up to 6 child profiles. How many children can use everything depends on your subscription (Article 8). An account for children is for one family. The account of an adult learning Dutch themselves is for that one person.
- You can always delete your account yourself in the app (Ouders → "Account" → "Account verwijderen", Delete account). A running subscription then stops at once; see Article 10(7). Before you delete the account, the app tells you what happens to your subscription.
- If you do not use your account for 24 months (you do not sign in and no progress is saved), we send you an email. If you then do not use it for 30 days, we delete the account and the progress in it. We never delete an account with a running subscription.
Article 7. Children and the responsibility of parents
- Children use Smartinga under your responsibility as parent or guardian. You decide whether and how long your child uses Smartinga.
- The settings, the account and the subscription are behind the parents' lock, with a PIN. Do not give your child that PIN.
- Smartinga shows children no prices, no advertising and no payment buttons, and children cannot buy anything in Smartinga.
Article 8. The subscription and the prices
- There are two subscriptions:
Subscription Children who can use everything Per month Per year Smartinga for 1 child 1 € 2.99 € 24.99 Smartinga for the family up to 3 € 4.99 € 39.99 - All prices include VAT. There are no other costs.
- If you have more children in your account than the subscription has places, you choose which children can use everything. The other children use the free part. You can change this choice once every 30 days.
- Before you take out a subscription, you see in the app and on the payment page the price, whether it is per month or per year, whether you get a trial and when the first payment is.
- You take out the subscription by pressing the button on Stripe's payment page that confirms the order (for example "Abonneren", subscribe, or "Proefperiode starten", start trial). After that you see the subscription's details in the app, under Ouders → Abonnement ("Parents → Subscription").
- A running subscription keeps the terms of when you took it out, except for what Articles 13 and 18 say.
Article 9. The free trial
- With your first subscription you get 14 days of everything free. You get one trial per account, also if you choose another subscription afterwards.
- You enter your payment details when you take out the subscription. The subscription continues after the 14 days and the first payment is on the day after the trial. You see that date before you take out the subscription, and in the app. If you do not want to pay, cancel before that day (Article 10); then you pay nothing.
- In the app (as soon as it is in the App Store or Google Play) the trial can also be taken without payment details. It then stops by itself after 14 days; nothing starts by itself.
- During the trial you can switch to another subscription for free.
Article 10. Paying, term, renewing and cancelling
Paragraphs 1 to 7 are about a subscription you take out on the website. Paragraphs 8 to 10 are about a subscription in the App Store or Google Play.
Paying
- You pay through Stripe, with iDEAL, a credit or debit card, Apple Pay, Google Pay or Bancontact. If you pay with iDEAL or Bancontact, the following payments are made by direct debit (SEPA) from your account. You pay per month or per year in advance. We do not keep your full card or bank details; Stripe has them.
- If a payment fails, you get a message in the app (under Ouders, "Parents"), and Stripe tries a few more times. Your children keep everything for 7 days. If it has still not been paid by then, they use the free part until the payment succeeds. If it does not succeed at all, the subscription stops. You can update your payment details under Ouders → Abonnement. We charge no extra costs for this.
- You find your invoices under Ouders → Abonnement → Facturen bekijken ("View invoices").
Term and renewing
- A monthly subscription runs per month and continues every month until you cancel.
- A yearly subscription runs for one year and then stops by itself; it is never renewed tacitly. From 30 days before the end you see this under Ouders. If you want another year, you choose "Verlengen" ("Renew") yourself (Ouders → Abonnement); you first see the amount and the date of the payment. A renewed year also stops by itself at its end.
Cancelling
- You can always cancel online, just as easily as you took out the subscription: Ouders → Abonnement → Abonnement opzeggen ("Cancel subscription", or Beheren, "Manage"). You do not have to give a reason.
- A monthly subscription stops at the end of the paid month.
- A yearly subscription stops at the end of the year anyway (paragraph 5); cancelling is not needed for that.
- Until the end your children can use everything; after that, the free part. What they did is kept.
- You see the cancellation in the app straight away, under Ouders → Abonnement.
- Within the withdrawal period you can also withdraw from the agreement; see Article 11.
- Deleting your account. If you delete your account, your subscription stops at once. If that is within the withdrawal period (the first 14 days), you get back everything you paid in that time (Article 11(5)). Otherwise you get no money back for the rest of the paid period.
In the App Store or Google Play
- As soon as the app is in the App Store or Google Play, you can take out a subscription in the app on an iPhone, iPad or Android device, in Apple's or Google's store. Apple or Google then sells you the subscription and handles the payment. Their rules then apply to paying, renewing, cancelling and refunds. How and when the subscription renews, you see in the store before you take it.
- You cancel such a subscription in the settings of your phone or tablet (in your Apple ID or your Google account). You also withdraw and ask for refunds at Apple or Google. Only deleting the app does not cancel the subscription.
- Apart from that, these terms also apply to a subscription from the store, such as your rights if Smartinga does
not work properly (Article 15).
Article 11. Withdrawal period (right of withdrawal)
- You have a 14-day withdrawal period. In that time you can withdraw from the agreement without giving a reason. The period starts on the day you conclude the agreement: the day you start the trial, or the day you take out a subscription without a trial.
- How to withdraw:
- in the app: Ouders → Abonnement → "Hier de overeenkomst ontbinden" ("Withdraw from the agreement here"). This button is there for the whole withdrawal period. You fill in your name (your email address and the subscription are already there) and press "Bevestig ontbinding" ("Confirm withdrawal"). You see a confirmation with the date and time straight away;
- or by email to info@smartinga.com, for example with the model form in Appendix 1. It is in time if you send it before the end of the withdrawal period.
- With a trial the withdrawal period coincides with the trial. You pay nothing in that time, so you get nothing back either. After you withdraw, the trial stops at once. If the subscription continues with payment after the trial, you get no new withdrawal period for that: at the start of the trial you knew that the subscription costs money afterwards, and how much.
- Without a trial (you already had a trial once) the subscription starts at once and you pay at once. You still have 14 days to withdraw.
- Your money back. If you withdraw from a paid subscription within the withdrawal period, it stops at once and you get everything back that you paid in the withdrawal period, within 14 days, with the same means of payment. You pay nothing for the days you already used Smartinga.
- The right of withdrawal does not lapse because you use Smartinga.
- You withdraw from a subscription from the App Store or Google Play at Apple or Google (Article 10(9)).
Article 12. Switching to another subscription
- Switching from "1 child" to "family", or from monthly to yearly (or the other way round), is done through Ouders → Abonnement. It goes through Stripe's page.
- If you switch to a more expensive subscription, it starts at once. You pay the difference for the rest of the current period with the next payment.
- During the trial, switching costs nothing.
- If you switch to a cheaper subscription, you see on Stripe's page beforehand when it starts and what you pay.
Article 13. Availability and changes
- We do our best to keep Smartinga working well at all times. Sometimes Smartinga cannot be reached for a while, for example during maintenance or an outage at a party we work with. Part of it then still works without internet. We fix an outage as quickly as is reasonable.
- We keep improving Smartinga: stories and exercises are added, and the app changes. We may change Smartinga if there is a good reason, for example to make the app better, safer or suitable for new devices, or because the law requires it. You pay nothing extra for this.
- If a change makes the use clearly worse for you (and it is not minor), we let you know at least 30 days in advance. You may then end the subscription free of charge, up to 30 days after the change took effect or after we told you (whichever is later). What you paid in advance for the time after that, you get back.
- Smartinga works in the common, up-to-date browsers. On very old devices or browsers it may not work.
Article 14. Content and use
- The stories, texts, drawings, sounds, exercises and the software of Smartinga belong to us or to our licensors. You and the children in your family may use them in Smartinga, for yourselves and at home.
- You may not:
- copy, sell, rent out or publish Smartinga or its content;
- use Smartinga for a business, a school or a paid lesson, without a separate agreement with us;
- use the content for a service that competes with Smartinga;
- collect the content automatically (for example with scripts or robots), or get around the security;
- use Smartinga in a way that harms the service or other users.
- If someone does not keep to this, we may block the account after a warning or, in case of serious misuse, at once. What you paid in advance for the time after that, you then get back, unless the law allows us otherwise.
Article 15. If Smartinga does not work properly
- You have the right to a service that does what you may expect (the rules for digital services in the Dutch Civil Code, title 7.1AA). If Smartinga does not work properly, email us. We fix it within a reasonable time, at no cost to you.
- If that does not work, you have the rights the law gives you: a lower price, or ending the subscription and money back for the time Smartinga did not work properly.
- That we use another party for part of Smartinga (for example for storage or payments) does not take anything away from these rights.
Article 16. Liability
- We are liable for damage you suffer because we do not keep to the agreement, as the law provides, with these limits:
- we are not liable for damage because Smartinga does not work for a while or has a fault, if we could not do anything about it (for example an outage at a party we work with or at your internet provider);
- we are not liable for a problem caused only by your own internet, device or browser settings;
- we are not liable for the loss of progress that was only on a device (Article 5), unless Smartinga caused that loss.
- These limits do not apply:
- if the damage comes from intent or deliberate recklessness on our part;
- in the case of death or injury;
- to damage to your device or to other digital content that Smartinga caused, where the law gives you a right to compensation;
- where the law says we may not limit liability.
- Your rights as a consumer always remain, such as withdrawing (Article 11) and your rights if Smartinga does not work properly (Article 15).
Article 17. End of the agreement
- You can stop using Smartinga whenever you want: cancel the subscription (Article 10) and delete the account (Article 6(4)).
- We can end a subscription with at least 2 months' notice, for example if we stop Smartinga. What you paid in advance for the time after that, you get back. We give you the chance to take your data with you (see the privacy statement).
Article 18. Changes to these terms and to the prices
- We may change these terms if there is a good reason, for example because Smartinga, the technology or the law changes. We tell you about an important change at least 30 days in advance, in the app and by email. If the change is to your disadvantage, you may cancel the subscription free of charge up to the day the change takes effect.
- We may change the prices, but not in the first 3 months after you took out your subscription. We tell you about a higher price at least 30 days in advance, by email. If you do not agree, you can cancel before the new price takes effect; until then you pay the old price. A year you have already paid for never becomes more expensive.
- We pass on a change in VAT in the price. We also tell you about that in advance, and then too you may cancel free of charge.
Article 19. Complaints
- Do you have a complaint? Email us at info@smartinga.com and describe as clearly as possible what is wrong. We confirm within 5 working days that we have your complaint, and answer within 14 days. If we need more time, we tell you within those 14 days why, and when you will get an answer.
- If we cannot work it out together, you can go to court (Article 20). We are not a member of a disputes committee.
Article 20. Law and court
- Dutch law applies to these terms and the subscription. If you live in another EU country, you keep the protection of the mandatory rules of the country where you live.
- A dispute goes to the court that has jurisdiction under the law. As a consumer you can in any case go to the court of the place where you live.
